View Rules Favor the Vegetation Violator

We are so fortunate to have view enforcement in Laguna Beach. The only problem is that we are not sure as to which side is being protected.

Recently I contacted the city for some assistance as there is an undeveloped property within 250 feet from our home that has a tree that not only blocks our view, it is so overgrown that it is actually a hazard to pedestrians on the sidewalk, as well as attracting the homeless as a place to gather and hide.

Upon contacting the city we were advised that I could file a complaint, which would cost me $500, and open a case. If we cannot come to terms (which has already unsuccessfully tried) that I can request a hearing that would cost us an additional $630. If we are able to prove our case, then we have the privilege of trimming the violators property and they would have to maintain it going forward.

I don’t see anything here motivating the violator to maintain the code. As a matter of fact all of the burden and cost is placed on the party that is being violated. In other words, by the time this issue is resolved the violated party will be out about $2,000, while the violators without any cost, or penalties will get this tree trimmed for free! Where is the logic in this? How many of the violated can afford this?

To avoid frivolous filings, whatever party is creating the problem should have to bare the costs. Otherwise there is no incentive in the violator maintaining the code.
